1. General Information

The Digital Data Chain Consortium GbR, Carl-Bosch-Straße 38, Building Q 920, 67056 Ludwigshafen Germany, hereinafter referred to as [DDCC], offers visitors to their website at www.digitaldatachain.com the Web Application, a web application with registration-free access. The use of the Web Application is subject to the following terms of use.

2. Scope and Functionalities

  • With the Web Application you can:
    • (1) View a VDI 2770 document container or VDI 2770 documentation container in human-readable form. The Web Application unpacks the VDI 2770 container and extracts the associated metadata and presents both in human-readable form.
    • (2) Create and download a VDI 2770 document container or VDI 2770 documentation container.
    • (3) Check a VDI 2770 document container or VDI 2770 documentation container for conformity to the specification. A test report is created and offered for download.
    • (4) Check an ID link according to IEC 61406 and generate the associated QR code.
  • The VDI 2770 functions designated with (1) and (2) run exclusively locally in the user's web browser. The Web Application does not transfer any data actively loaded by the User from the web browser from the user's local computer to a server or other location, except for personal information collected when visiting this website (see privacy policy).
  • The ID link generation (4) and the verification of a VDI 2770 container (3) takes place on a server, for which the data is transferred from the Web Application to the server. The ID link is stored, all other data is deleted after completion of the verification. Only anonymized error reports are stored.
  • DDCC reserves the right to expand or reduce the number and scope of the functions provided until the termination of the Web Application.
  • DDCC provides the Web Application exclusively to commercial users in their capacity as 'entrepreneurs' within the meaning of § 14 para. 1 BGB, hereinafter referred to as [User], for free use. An entrepreneur is a natural or legal person or a legal partnership that acts in the exercise of their commercial or independent professional activity when concluding a legal transaction. 'Consumers' within the meaning of § 13 BGB may not use the Web Application.
  • The use of the Web Application is based exclusively on these terms of use and any information provided on the Web Application. Deviating or conflicting conditions will not become part of a contract with DDCC, unless DDCC has expressly agreed to them in writing.

3. Access to the Web Application

  • Access to the Web Application is free and takes place without registration of the User.
  • By accepting the terms of use by confirmation via the control panel provided for this purpose in the Web Application, the User bindingly declares to DDCC that they accept these terms of use. The User also declares that they will use the Web Application exclusively for their business purposes. Any other use of the Web Application by the User or by third parties is prohibited.
  • These terms of use are concluded in German.
  • These terms of use are stored by DDCC and can be accessed by the User at any time on the Web Application.

4. Provision of the Web Application

  • DDCC enables access to and use of the Web Application to a reasonable extent. DDCC provides access to the Web Application in a hosted environment that enables the User to use the Web Application via the Internet without having to install and operate the software on their own IT infrastructure.
  • DDCC will endeavor within reasonable limits to maintain the availability of the Web Application for use by the User at the interface between the public Internet and the hosting server network. The Web Application is 'available' when it is usable at the gateway between the public Internet and the hosting server network.
  • DDCC strives to ensure trouble-free operation of the Web Application during DDCC's usual business hours in Germany. The Web Application may also be accessible to the User outside of DDCC's usual business hours in Germany. However, due to the nature of the Internet and computer systems, DDCC does not guarantee trouble-free operation of the Web Application and assumes no liability for the availability of the provided application or services.
  • DDCC is free to restrict access to the Web Application in whole or in part, temporarily or permanently due to maintenance work, capacity concerns and other events not attributable to it. In principle, DDCC will maintain the Web Application outside of usual business hours, unless an urgent event requires maintenance during usual business hours.

5. User Obligations

  • The User is solely responsible for all content that they upload, publish or otherwise make accessible via the Web Application. DDCC does not check the content, especially not for completeness, correctness, legality, availability, quality and suitability for a specific purpose.
  • The User is prohibited from any activities on or in connection with the Web Application that violate applicable law, infringe the rights of third parties or violate principles of youth protection.
  • Furthermore, regardless of a legal violation, the User is also prohibited from carrying out the following activities:
    • the distribution of viruses, trojans and other harmful files;
    • the sending of junk or spam emails and chain letters;
    • the distribution of insulting, offensive, sexually oriented, obscene or defamatory content or messages as well as such content or messages that are suitable for promoting or supporting racism, fanaticism, hatred, physical violence or illegal acts (either explicitly or implicitly);
    • the harassment of other Users, e.g. through multiple personal contact without or against the reaction of the other user as well as the promotion or support of such harassment;
    • the request of other Users to disclose passwords or personal data for commercial or illegal purposes;
    • the distribution and/or public reproduction of content available in the Web Application.
  • The User releases DDCC (including members of the company and any service recipients, their employees, executives, directors, shareholders, representatives, successors and authorized representatives) from any claims, lawsuits, damage claims, costs, fines and expenses (including reasonable attorney fees and expenses) or other liability arising from or in connection with the User's content on the Web Application.
  • DDCC reserves the right to exclude Users from using the Web Application, especially if these terms of use, applicable law or third party rights are violated.

6. Usage Rights to the Web Application

  • DDCC grants the User the non-exclusive, non-transferable and revocable right to use the Web Application in accordance with these terms of use. The content available on the Web Application is protected by copyright or other commercial property rights. Rights holders are DDCC, their business partners or other third parties who have made the respective content available. The Web Application and the content made available on the Web Application may therefore not be modified, extended, processed, copied and/or otherwise distributed by the User.
  • The User undertakes not to reproduce, distribute, modify or create derivative works from the Web Application or other components thereof and not to reverse engineer or decompile the Web Application, unless this is permitted under mandatory law.
  • Insofar as the User publishes content on the Web Application, the User grants DDCC a non-exclusive, worldwide, unlimited and free right to use the content for the operation of the Web Application.

7. Duration of Use and Termination

  • These terms of use are concluded for an indefinite period and can be terminated by either party at any time with immediate effect without giving reasons. Termination by the User must be made in writing to the following address: Christoph Attila Kun, BASF SE, Carl-Bosch-Straße 38, Building Q 920, 67056 Ludwigshafen.
  • The usage relationship ends automatically at the latest with the termination of the operation of the Web Application by DDCC.
  • The right of each party to terminate these terms of use for good cause with immediate effect remains unaffected.
  • Upon termination of these terms of use, the User will immediately cease using the Web Application.

8. Rights for Defects and Liability Limitation

  • As long as the Web Application is made available to the User free of charge, liability for defects in the functions of the application and its documentation as well as for other poor performance towards the User is limited to intent and fraudulent intent.
  • As a service provider, DDCC is responsible according to § 7 para. 1 TMG for its own content and information provided in the Web Application according to general laws; however, DDCC is not obligated to monitor transmitted or stored third-party information. Removal or blocking of this content takes place immediately from the time of knowledge of a specific legal violation. Liability is only possible from the time of knowledge.
  • Further damage and expense compensation claims of the User (hereinafter 'damage compensation claims'), regardless of the legal basis, especially due to violation of obligations from the debt relationship and from tort, are excluded. Insofar as this usage relationship falls under rental law regulations, the provider's liability independent of fault for defects already existing at the time of contract conclusion according to § 536 a para. 1 (1st alternative) BGB is excluded.
  • The above liability limitations do not apply insofar as there is mandatory liability, e.g. under the Product Liability Act, in cases of intent and gross negligence, due to injury to life, body or health, due to the assumption of a guarantee or due to fraudulent intent or intent.

9. Data Protection

DDCC observes all applicable data protection regulations. Further information can be found in the respective valid Privacy Policy.

10. Confidentiality

  • The User is obligated to treat confidentially and keep secret the confidential information that comes to their knowledge, especially in connection with the use of the Web Application.
  • 'Confidential Information' means all information of DDCC:
    • about the functionalities of the Web Application;
    • that concern business and trade secrets, especially those marked as 'confidential'; and
    • that - orally, in writing, electronically or in any other form - are recognizable as confidential at the time of disclosure or knowledge due to the circumstances of disclosure or their nature.
  • Excluded from this obligation are such Confidential Information:
    • that were provably already known to the User at the time of conclusion of the terms of use or that subsequently become known to the User through a third party, without this violating confidentiality agreements, legal provisions or official orders;
    • that are publicly known at the time of contract conclusion or subsequently become publicly known, unless this is based on a violation of these terms of use;
    • that must be disclosed due to legal provisions or by order of a court or an authority. As far as permissible and possible, the User obligated to disclose will inform DDCC in advance and give DDCC the opportunity to object to the disclosure.
  • This confidentiality obligation continues to exist even after termination of the terms of use for a period of five (5) years, unless a longer confidentiality period has been otherwise agreed between DDCC and the User.

11. Changes to the Terms of Use

Since access to the Web Application is free and takes place without registration of the User, the version of the terms of use provided at the time of use of the Web Application applies, the acceptance of which the User confirms before using the Web Application through the feedback in the control panel provided for this purpose.

12. Miscellaneous

  • Should one or more provisions of these terms of use be invalid or unenforceable due to violation of applicable law or for other reasons, the terms of use remain valid in other respects. The invalid or unenforceable provision is to be replaced by a valid, enforceable provision that comes closest to the mutual understanding of the parties.
  • Validity, interpretation and implementation of this contract are subject to the substantive law of the Federal Republic of Germany excluding conflict of laws and the United Nations Convention on Contracts for the International Sale of Goods of April 11, 1980.
  • Ludwigshafen am Rhein is agreed as the exclusive place of jurisdiction for all disputes arising from or in connection with these terms of use.
